Digital Product License & Refund Terms
Effective Date: September 26, 2026
These Digital Product License & Refund Terms apply to digital products, templates, systems, calculators, guides, downloads, and other digital resources purchased from Samantha Diaz, a California sole proprietor doing business as The Hot Mess Collective (“THMC,” “we,” “us,” or “our”).
These terms supplement the THMC Terms & Conditions. If a specific product page, checkout, license, or written agreement includes different terms for a particular purchase, those product-specific terms control to the extent they conflict with these terms.
Your license
When you purchase a THMC digital product, you receive a limited, non-exclusive, non-transferable license to use that product for your own personal use or the internal operations of your own business.
You may download, store, duplicate, edit, and customize the materials as reasonably necessary for that permitted use.
You may use THMC workflows, processes, prompts, checklists, calculators, templates, frameworks, and other included materials to operate your own business.
Your purchase gives you permission to use the product. It does not transfer ownership of the product or THMC intellectual property to you.
What you may not do
Unless THMC gives you written permission, you may not:
Resell, redistribute, sublicense, or give away the product or its source files.
Share the product with another business, organization, purchaser, client, or the general public.
Upload or make the materials available through a template library, membership, marketplace, shared drive, file-sharing service, resource repository, course, or similar collection.
Sell substantially unchanged THMC materials as your own product.
Package THMC materials into another product or service for redistribution to third parties.
Claim authorship or ownership of THMC-created materials.
Remove or misrepresent THMC ownership or attribution where attribution appears in the original materials.
You may use what you learn from a THMC product in the normal operation of your business. You may not turn the purchased materials themselves into a product for someone else.
Use by employees and contractors
You may share a purchased product with employees or contractors who reasonably need access in order to perform work for your business, provided the materials remain for your internal business use.
You are responsible for ensuring those individuals do not independently copy, distribute, resell, publish, or reuse the materials for another business.
This permission does not create a multi-business, agency, consultant, or resale license.
Third-party tools and accounts
Some THMC products may reference, recommend, link to, or be designed for use with third-party software, platforms, services, or accounts.
Unless the product page expressly says otherwise, your purchase does not include third-party subscriptions, software licenses, accounts, implementation services, integrations, or access permissions.
You are responsible for:
Obtaining any third-party tools or accounts you choose to use.
Paying applicable third-party fees.
Reviewing the provider’s current functionality and terms.
Determining whether the provider is appropriate for your business and circumstances.
Third-party products and platforms can change their pricing, features, interfaces, policies, or availability after a THMC product is published.
Digital-product delivery and refunds
THMC digital products are delivered electronically.
Because digital materials cannot meaningfully be returned after access or delivery has been provided, digital-product purchases are generally final once the download, access link, or purchased material has been delivered.
This policy does not limit any refund, replacement, warranty, or consumer right that cannot lawfully be excluded.
If:
You receive the wrong product.
THMC delivers a corrupted or unusable file.
You cannot access your purchase because of a THMC delivery issue.
The material delivered is materially different from the product you purchased.
contact THMC so the issue can be reviewed and, where appropriate, corrected, replaced, or otherwise resolved.
A change of mind, failure to use the product, purchase of the wrong product by the customer, or a decision not to implement the materials does not ordinarily create a refund right unless applicable law requires otherwise.
Updates and future versions
Unless the product page expressly states that future updates are included, your purchase provides access to the version offered at the time of purchase.
THMC may revise, correct, expand, replace, discontinue, repackage, rename, or combine products in the future without creating an obligation to provide future versions to previous purchasers.
THMC may choose to provide updates or replacement files at its discretion.
Support and implementation
Purchasing a digital product does not include consulting, customization, implementation, technical support, software configuration, or other professional services unless those services are expressly included in the offer.
Questions about purchasing, accessing, or receiving the files are different from implementation services.
If your problem extends beyond the purchased system and requires custom workflow, CRM, automation, website, operational, or implementation work, those services may be available separately through THMC Studio.
Educational and operational use
THMC digital products are educational and operational resources intended to help businesses examine, document, improve, or implement their own systems.
They are not legal, tax, accounting, financial, medical, mental-health, regulatory, employment, privacy, cybersecurity, accessibility, or other licensed professional advice.
You are responsible for reviewing the materials before implementation and determining whether they are appropriate for your:
Business.
Jurisdiction.
Industry.
Customers or clients.
Technology.
Contracts and policies.
Legal or regulatory obligations.
Individual circumstances.
Where licensed or specialized professional review is appropriate, you are responsible for obtaining it.
No guaranteed results
THMC does not guarantee that use of a digital product will produce revenue, sales, leads, profit, cost savings, increased efficiency, regulatory compliance, search performance, customer retention, operational improvement, or any other particular result.
The usefulness and results of a system depend on factors such as your implementation, business model, existing processes, customers, team, technology, market conditions, and circumstances outside THMC’s control.
Intellectual property
THMC and its licensors retain all rights in THMC-created product materials, including original copy, designs, frameworks, templates, worksheets, calculators, workflows, processes, documentation, graphics, and other protected materials.
Any rights not expressly granted by these terms are reserved.
Your purchase does not grant you rights to THMC trademarks, branding, trade names, or other brand assets except as necessary to identify the source of the product.
Violations of the license
THMC may terminate a purchaser’s license to use the materials if the purchaser materially violates these terms.
Termination does not authorize continued copying, redistribution, resale, sublicensing, publication, or other prohibited use of the materials.
THMC retains any rights or remedies available under applicable law for unauthorized use or distribution of its intellectual property.
Relationship to the Terms & Conditions
These Digital Product License & Refund Terms are incorporated into the THMC Terms & Conditions.
The general Terms & Conditions continue to govern website use, purchases, intellectual property, disclaimers, limitations of liability, dispute provisions, and other matters not specifically addressed here.
Where mandatory consumer law gives you rights that cannot legally be waived or excluded, those rights continue to apply.
